Terms of Service

1. Acceptance of Terms

By creating an account or using the Service, you agree to comply with these Terms and our Privacy Policy. You must accept the current version of these Terms via the acceptance prompt when required. If you do not agree to these Terms, you may not use the Service.

You must be at least 16 years old to use the Service, in accordance with the Belgian implementation of the GDPR. Where local law permits a lower age of digital consent (but no lower than 13), parental or guardian consent is required.

2. Service Description

Hylist is a platform that allows users to discover, list, and vote for Hytale game servers. The Service includes:

• Server listing directory with search and filtering
• Voting and review system for listed servers
• Auctions for sponsored placement positions
• Telemetry and analytics for server owners
• Subscription plans with tiered features

3. User Accounts

To access certain features of the Service, you must sign in using Discord OAuth. By doing so, you agree to:

• Provide accurate information and keep your account secure
• Be responsible for all activities that occur under your account
• Not share your account credentials or transfer your account to others
• Notify us immediately of any unauthorized use of your account
• Maintain only one account per person

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time; see our Privacy Policy for details on data retention after deletion.

4. Server Listings

When listing a server on Hylist, you represent and warrant that:

• You have the authority to list the server
• All information provided is accurate and not misleading
• Your server complies with all applicable laws and regulations
• Your server does not infringe on any third-party rights
• You will keep listing information up to date

We reserve the right to remove any server listing at our discretion, without prior notice, for any reason including inaccuracy, inactivity, or policy violations.

5. Voting & Reviews

Voting is protected by Cloudflare Turnstile to prevent fraud. By voting or submitting reviews, you agree to:

• Not manipulate votes through bots, fake accounts, vote exchanges, or any other fraudulent means
• Submit honest and accurate reviews based on genuine experience
• Not engage in review manipulation, including incentivized or coordinated reviews

Reviews are subject to moderation. We may approve, deny, edit, or remove reviews at our discretion. Repeated violations may result in account suspension.

6. Subscriptions & Payments

6.1 Subscription Tiers

We offer the following subscription tiers: Starter, Growth, Professional, and Enterprise. Each tier provides different features and telemetry data retention periods. Current pricing and feature details are displayed on the Service.

6.2 Payment Processing

All payments are processed by Polar. Subscriptions are billed on a recurring monthly basis. You are responsible for ensuring your payment method remains valid.

6.3 Refund Policy

All payments are final and non-refundable. This applies to subscription fees, auction payments, verification amounts, and credit purchases.

By completing a purchase, you expressly consent to immediate delivery of the digital service and acknowledge that you waive your right of withdrawal under Article VI.53 of the Belgian Code of Economic Law (implementing Directive 2011/83/EU, Article 16(m)), as the service is fully performed immediately upon purchase.

7. Auctions for Sponsored Placement

7.1 Overview

The Service offers 5 sponsored placement positions per auction cycle. Positions are awarded through a real-time bidding system. Participation requires account verification via Polar.

7.2 Verification

To participate in auctions, you must complete a verification process via Polar. The verification amount is non-refundable and is converted to credits upon successful verification.

7.3 Bidding Rules

• All bids are final and cannot be withdrawn once placed
• Auto-bidding is available; you are fully responsible for all bids placed by the auto-bidding system on your behalf
• You must ensure sufficient credits or payment ability to cover your bids

7.4 Credits

Credits are used for bidding in auctions. Credits have no cash value, are non-transferable, and cannot be withdrawn or refunded. Credits may be forfeited upon account termination.

7.5 Payment & Forfeiture

Winning bidders must complete payment by the deadline specified at the end of each auction cycle. Failure to pay may result in forfeiture of the sponsored position, loss of credits, and potential account restrictions.

7.6 No Refunds

All auction-related payments are non-refundable, including verification amounts, credit purchases, and winning bid payments.

7.7 Notifications

Auction-related notifications (outbid alerts, cycle results) may be sent via Discord DM if you have opted in. You are responsible for monitoring your bids regardless of notification delivery.

8. Telemetry

Server owners who enable our telemetry feature acknowledge and agree that:

• They are responsible for informing their players about the data collection performed by the telemetry system
• Hylist acts as a data processor on behalf of the server owner (data controller) for telemetry data
• Telemetry data collected includes: player join events, player country (derived from IP), client version, and locale
• Telemetry data retention varies by subscription tier (7 to 365 days)
• IP addresses are used to derive country information and are not stored directly

9. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Post false, misleading, or deceptive content
• Manipulate voting systems through bots, fake accounts, or other fraudulent means
• Engage in auction manipulation, including collusion, shill bidding, or bid rigging
• Circumvent or attempt to circumvent Cloudflare Turnstile or other anti-fraud measures
• Create or operate multiple accounts (multi-accounting)
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers connected to the Service
• Upload malware, viruses, or other malicious code
• Scrape, crawl, or collect data from the Service without permission
• List servers promoting illegal activities, hate speech, or explicit content

10. Intellectual Property

The Service and its original content (excluding user-generated content) are the property of A-Line Services and are protected by copyright, trademark, and other intellectual property laws.

By submitting content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with the Service for as long as your content remains on the platform.

Hylist is not affiliated with or endorsed by Hypixel Studios, Mojang Studios, or Microsoft. Hytale and related trademarks are the property of their respective owners.

11. Third-Party Services

The Service integrates with or relies on third-party services, including:

• Polar: Payment processing for subscriptions and auctions. Your use of Polar is subject to their terms of service.
• Discord: OAuth authentication and optional DM notifications. Your use of Discord is subject to their terms of service.
• Third-party game servers: Servers listed on Hylist are operated by independent third parties. We are not responsible for their content, practices, or availability. You connect to and use these servers at your own risk.

12. Content Moderation

We reserve the right to moderate all user-submitted content, including server listings, reviews, and profile information. We may approve, deny, edit, or remove any content at our discretion, without prior notice, for any reason including policy violations, inaccuracy, or inappropriate content.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the conduct of users or the content of server listings. We are not liable for missed bids, failed transactions, or other losses resulting from connectivity issues, service interruptions, or technical failures.

14. Limitation of Liability

To the maximum extent permitted by Belgian law:

• A-Line Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from your use or inability to use the Service.
• Our aggregate liability for all claims arising out of or related to the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded under mandatory Belgian or EU law.

15. Indemnification

To the extent permitted by applicable law (including Belgian consumer protection law), you agree to indemnify and hold harmless A-Line Services from any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights. This indemnification obligation does not apply to claims arising from our own negligence or wilful misconduct.

16. Termination

We may terminate or suspend your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service will immediately cease
• Any active bids in ongoing auctions will be voided
• Any pending payment obligations remain due
• Any remaining credits will be forfeited
• Server listings associated with your account will be removed

The following sections survive termination: Subscriptions & Payments (6), Intellectual Property (10), Disclaimers (13), Limitation of Liability (14), Indemnification (15), Governing Law (18), and any other provisions that by their nature should survive.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. When we update these Terms, you will be required to re-accept the new version before continuing to use the Service. The terms version is tracked in your account, and the acceptance prompt will appear automatically when a new version is published.

18. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Belgium.

If you are a consumer in the European Union, you retain any mandatory protections provided by the consumer protection laws of your country of residence, which cannot be overridden by these Terms.

19. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and A-Line Services regarding the Service.
